Electric bikes are booming across Florida
Electric bikes have become one of the fastest-growing ways to get around Florida. More riders on the road has meant more crashes. Flat terrain, warm weather, and a year-round riding season make e-bikes popular with commuters, students, and retirees alike. You’ll see them weaving through downtown Orlando and Tampa, cruising beach paths near Palm Beach Gardens, and running errands in neighborhoods around Rockledge and Winter Haven. Here’s the problem: e-bikes are faster and heavier than traditional bicycles, so when a rider collides with a car, truck, or fixed object, the injuries tend to be serious. Plenty of drivers still aren’t used to sharing the road with bikes that can keep pace with city traffic, and that gap in awareness leads to preventable collisions. Too often, the rider pays the price for someone else’s carelessness.
Common causes of e-bike accidents
Most e-bike crashes stem from someone else’s negligence. Drivers routinely fail to see or respect riders, and the results can be life-changing. The crashes we see most often involve:
– Driver negligence, including failure to yield, distracted driving, speeding, and running red lights or stop signs
– Dooring, when someone opens a car door directly into a rider’s path
– Unsafe passing, where a vehicle gives a rider too little room and clips them or forces them off the road
– Road hazards, such as potholes, broken pavement, and poorly maintained bike lanes
– Defective e-bike components, such as faulty brakes, batteries, or throttles that fail without warningr
Pinning down what actually caused your crash matters because it points to who’s responsible and who should pay. The attorneys at JustCallMoe dig into the details so nothing gets overlooked. Call 866-654-7499 for a free case review.
How Florida classifies e-bikes
Florida classifies electric bicycles into three classes based on how the motor works and how much it assists you. Under Florida Statutes section 316.003, an electric bicycle has fully operable pedals and a motor with a power output of less than 750 watts. Class 1 e-bikes assist only while you pedal and cut off at 20 miles per hour; Class 2 e-bikes have a motor that can propel the bike on its own and also cut off at 20 miles per hour; and Class 3 e-bikes assist only while pedaling and cut off at 28 miles per hour.
Why does this matter? Florida treats e-bike riders a lot like bicycle riders. They have the same rights and duties on the road and can ride on streets, roadways, shoulders, bike lanes, and multiuse paths. No driver’s license, registration, or motor vehicle insurance is required. That legal status shapes how your claim and any insurance dispute play out, which is where having a lawyer in your corner pays off.
Who can be held liable for an e-bike accident
More than one party may be responsible for an e-bike crash, and identifying each one is key to full compensation. Often it’s a negligent driver who turned without looking, followed too closely, or just wasn’t paying attention. Sometimes an employer shares responsibility when the at-fault driver was working at the time of the crash. When a mechanical failure causes the wreck, the manufacturer or seller of a defective e-bike or component may be liable under product liability law. And when a dangerous road condition is to blame, such as a crumbling bike lane or a pothole a city failed to repair, a government entity responsible for that road may share the fault. Sorting out who’s accountable takes a close look at the evidence, from the police report to the bike itself. Don’t let the insurance company decide that for you. Injuries and compensation in Florida e-bike cases
E-bike riders have almost no protection in a collision, so injuries are frequently severe. We handle cases involving traumatic brain injuries, spinal cord damage, broken bones, road rash, and internal injuries. These can mean months of treatment, time away from work, and lasting pain that reshapes daily life. Serious e-bike injuries also carry long-term costs that aren’t obvious at first, from follow-up surgeries to physical therapy and lost future earnings.
Florida law allows injured riders to seek compensation for medical bills, future medical care, lost wages, reduced earning capacity, and pain and suffering. Two rules are worth knowing. First, Florida now follows a modified comparative negligence system, so if you’re found more than 50% at fault for the crash, you cannot recover damages, and any smaller share of fault reduces your recovery proportionally. Insurance companies know this and will try to shift blame onto you. Second, you generally have two years from the date of a negligence-based injury to file a lawsuit in Florida. Wait too long, and you can lose the right to recover anything.
